VENDOR TERMS & CONDITIONS

By joining West Coast Craft as a Vendor, you agree to the Terms & Conditions listed below.
01. Contract for Space
This application for space in West Coast Craft, subsequent formal notice of assignment by West Coast Craft ("WCC"), and the full payment of booth space cost, or use of credit from a previously cancelled show, constitute a contract for the right to use Booth Space ("Space"). WCC reserves the right, in its discretion, to make modifications to the size or configuration of each Space as may be necessary, provided any such adjustment is made equitably to each Vendor affected.
02. Payment for Space
Payment for Space must be made in U.S. funds for the full amount contracted and payable to West Coast Craft within 48 hours of receiving an acceptance notice (or confirmation that credit from a previously cancelled show is being used). Vendor spaces are not guaranteed until full payment is received.
03. Cancellation Policy
The event will proceed regardless of weather. WCC reserves the right to cancel the event due to unforeseen circumstances, including but not limited to acts of God, natural disasters, government regulations, public health emergencies, or any circumstance which may compromise the safety of vendors and attendees. If such a cancellation occurs, the event will not be rescheduled and no refunds will be issued. If a space is cancelled by a Vendor up to 30 days before the first day of the event weekend, the Vendor will receive a full refund minus the application fee. Application fees are non-refundable regardless of acceptance status. If a space is cancelled within 30 days of the first day of the event weekend, no payment or part of payment will be refunded. Refunds, when applicable, will be issued to the original form of payment within 30 days of cancellation approval. Any space not claimed, occupied, or otherwise arranged with and approved by WCC in writing by 9:00pm on the Friday preceding event weekend may be reassigned without further notice and without refund.
04. Rental Space Usage
All exhibits must conform to fire and building codes set by the City of San Francisco, the State of California, and the National Park Service. Exhibitors must not engage in any activity that disturbs fellow vendors' ability to exhibit.
05. Agreed Upon Space
All booths and booth combinations are assigned by WCC and may be subject to change. Electrical outlets are not included. Plumbing requirements must be self-contained. Custom signage and displays are permitted at the Vendor's expense, but must not interfere with or obstruct adjacent booths or vendor spaces.
06. Subletting Space
Vendors shall not assign or sublet their space without prior written permission from WCC. All activities, sales, or demonstrations must occur within the assigned booth. Vendors may only display and sell merchandise they themselves produce or carry in the normal course of their business.
07. Restrictions in Operations of Exhibits and Artwork
WCC reserves the right, in its sole discretion, to restrict or remove any exhibit, vendor, or material that is objectionable due to noise, content, operation, or general character. Vendors may be removed without refund if their conduct or materials are deemed harmful, offensive, or disruptive to the integrity of the show.
08. Photography, Social Media, and Advertising
Vendor acknowledges that WCC and its partners may engage photographers and/or videographers during the event. Vendor (and its employees, representatives, and contractors) may appear in promotional photos and/or videos. By participating, Vendor grants WCC and its partners irrevocable rights to use any such content in any format, including digital and social media, for promotional purposes. Vendor agrees that WCC and its partners’ use of such images will not violate the rights of any party, including but not limited to copyright, trademark, right of publicity, or privacy.
09. Care of Venue and Equipment
Vendors must not injure, deface, or damage venue property or equipment. Vendors are liable for any damage they cause to the venue, Space, or neighboring booths.
10. Liability
WCC, its staff, agents, and Fort Mason Center are not responsible for injury, theft, or damage to Vendor property. Vendors shall hold harmless and indemnify WCC and Fort Mason Center from any claims or damages related to Vendor participation. Vendors must provide a Certificate of Insurance with the following minimum coverage:
- General Liability: $1,000,000 per occurrence
- Damage to Rented Premises: $100,000
- Medical Expense: $5,000
- Personal & Advertising Injury: $1,000,000
- General Aggregate: $2,000,000
- Products/Completed Operations: $2,000,000
11. Circulation and Solicitation
Vendors may distribute promotional material only within their assigned Space. Solicitation by individuals or organizations not registered as Vendors is not permitted. Vendors are encouraged to report any such occurrences to WCC.
12. Amendments and Waivers
This Agreement represents the entire understanding between WCC and the Vendor. No terms may be modified except in writing signed by both parties. If any part of this Agreement is found invalid, the remainder shall remain enforceable.
13. Governing Law/Arbitration
This Agreement shall be governed by California law. Any disputes shall be settled by binding arbitration in San Francisco under the rules of the American Arbitration Association. The prevailing party shall be entitled to reasonable legal fees and costs.
14. COVID-19 Safety Protocols
Vendors agree to follow all current COVID-19 guidelines as communicated by WCC and venue staff. Protocols are subject to change based on evolving public health guidance. Non-compliance may result in removal without refund.
15. Correspondence
By applying, Vendors agree to receive emails from WCC. Email addresses will never be sold or shared with third parties. To unsubscribe, email info@westcoastcraft.com.
16. Force Majeure
West Coast Craft (WCC) shall not be held liable for any failure or delay in performance of its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather, fire, flood, pandemic, government orders or restrictions, labor disputes, utility failures, acts of terrorism, civil unrest, or any other event or cause beyond the reasonable control of WCC. In such cases, WCC shall be excused from performance without liability, and no refunds shall be issued. Vendors agree that WCC shall not be responsible for any loss or damage arising from such events.
